amicus & appeal update
Recipients of "Justice for Sholom" e-mails have long been aware of the overly aggressive treatment Sholom Rubashkin has received. But now there's a growing chorus of voices who have publicly criticized the fairness of Mr. Rubashkin's prosecution, trial and sentence.
The legal community, elected representatives and members of the general public have begun to recognize that this was not just a prosecution that practiced overzealousness - but a prosecution that practiced misconduct. They have further decried Judge Linda Reade's excessive involvement in the planning of the raid, portraying the appearance of improper bias in the trial of Mr. Rubashkin.
Recently, three well respected organizations have come out in support of Mr. Rubashkin's recent appeal brief filed by his attorneys led by Nathan Lewin: The ACLU of Iowa, the National Association of Criminal Defense Lawyers (NACDL) and theWashington Legal Foundation (WLF) have all filed amicus briefs with the 8th Circuit Court of Appeals. Their amicus briefs were signed by 25 professors and legal scholars, including Professor Alan Dershowitz and James H. Reynolds - former U.S. Attorney for the Northern District of Iowa.
Read more about it in the National Law Journal here.
Also noteworthy is that over 30 Members of Congress have written to Attorney General Eric Holder urging the Department of Justice to investigate these allegations of misconduct.
