Lawyers for Sholom Mordechai Rubashkin have filed a petition for a writ of certiorari for the United States Supreme Court. We will simultanoiusly petition on high to the True Judge, Avinu Shebashamaim.

Represented by acclaimed attorneys Paul Clement and Nathan Lewin, Sholom Mordechai asked the high court to review his case because of erroneous rulings by the Eighth Circuit Court of Appeals.
Foremost among these rulings, the Eighth Circuit in its Sept. 2011 decision refused to consider evidence of judicial and prosecutorial misconduct, discovered after the trial, which rendered the trial unfair. The petition also seeks relief from the Supreme Court for the draconian 27-year sentence imposed by Judge Linda Reade.
“This case presents two issues of extraordinary importance to both criminal defendants and the criminal justice system as a whole,” the petition stated. when confronted with the argument that its “probable acquittal” standard makes no sense, the Eighth Circuit refused to budge: even when the new evidence concerns judicial bias or prosecutorial misconduct, it said, to merit a new trial, the evidence must offer compelling proof of the defendant’s innocence.
The rule is not only illogical but conflicts with the decisions of the Fourth, Ninth, and Eleventh Circuits,” the brief attested.
“The Supreme Court will surely recognize how outrageous and unjust Mr. Rubashkin’s prosecution and conviction have been,” said Nathan Lewin who argued the Rubashkin appeal in the Eighth Circuit, and who jointly authored the petition for certiorari with Paul Clement. “The justices will, with G-d’s help, review and reverse the decision so that Sholom will be able to return as soon as possible to his loving family and community.”

I am writing this letter with a Hatzo’o -- a suggestion in connection with the Yom HaBohir
Hey Teves, the day of Didon Notzach, which this year falls on Shabbos Kodesh Vayigash.
My proposition and suggestion is that we dedicate the Motzoi Shabbos of Shabbos Vayigash to make as many Melaveh Malkahs as possible everywhere in the world in the Zechus of our dear friend and colleague, Sholom Mordechai ben Rivkah, HaLevi, that he should have his own day of liberation, a Geulah Shelaymah, with a complete Didon Notzach.
I do not have to tell you that Melaveh Malkah, the Seudah of Dovid Malkoh Meshicho, is a very auspicious time to be Me’Orer Rachamim Rabim. I am sure you aware that Reb Sholom Mordechai always took great pains to make a beautiful Melaveh Malkah and invite many people. This is one of his special Mitzvos which will certainly stand him in good stead.
I am suggesting that we make Melaveh Malkahs in our shuls, in our Botei Chabad, and in our homes. I am asking everybody to please accept the idea and to let as many people as possible know about the idea. May HaKodesh Baruch Hu hear our prayers and, “Terem Nikro v’Ani E’eneh” – He should answer us even before we call out to Him with a true and complete Didon Notzach – with Moshiach Tzidkeinu, now, MAMOSH.
