I'm vey turned off from avi Moskowitz's support of judge "Royale" in agreeing that an excessive guidelines sentence is acceptable for a judge to impose. When a guidelines sentence tally is unfair and unequal, the judge is required to impose a fair sentence based on u.s.c. 3553(a).
He also was not truthful when he said that other offenders received similar sentences. He would not be able to back that up with even one example. In other cases of very severe sentences, either the loss was much, much bigger; or else the loss would have been intended theft - unlike Rubashkin.
