Letter from Sholom Mordechai

at the siyum of the speacial teffilah there are three simple Brochois that the whole klal says together after the chazan, and we all say amen. one of them is LECHAIM VELOI LAMOVES. we are summing up all the piyutim about the Brocho of Geshem with this simple three words! Life and not death.
he was was saying that there is a Chakira, why are we saying the Request for Life in a double fashion?.
Lechaim means to or for Life. LOI LAMOVES means not to, or for, Death. that could be said simply. LECHAIM.
if we are asking for Life to live and we are given Life to live, then obviously there is no death.
bederech tzachus, here in prison there is a different meaning to the word "life".
when someone says he got "life", we all know that we are not asking for it.
also, the one that did not get "life" is definitely not asking for it.
actually he is trying every way he can to get rid of his receiving "life"
here " Life" means Death.
but, i do not think that is why we are all saying Lechaim Veloi Lamoves.
the one explaining said that just because a person does not die ("LOI LAMOVES") , does not mean automatically, that the person is living. some people wake up in the morning, gis negel vasser, daven and go to work. they are not dead, But they are also not alive. it may very well be that the guy was not run over by a truck and died but that is not truly being alive.
LIFE means GELEBT, Chayois in a mitzvah, Varemkeit in doing a yid a favor, simcha in learning. azoi hut men geredt.
so, being alive is not only because death has not occurred yet. being alive is a Metzius onto itself.
But, one can only be truly alive when he is connected to the Mokoir of all life and existence, which is Hashem, HU ELOKIM CHAIM. the posuk in the Novei is, VEHASHEM ELOKIM EMES HU ELOKIM CHAIM. Like Life that is forever so truth is Forever. there can be no change in life as there can be no change in truth. they are constantly the same in every place and in ALL Time. therefore for a creation like a person to be alive is, only by doing what its in the Posuk." Veatem Hadvekim Bahasehm Eloikechem CHAIM KULCHEM hayoim". Life is when we are dovuk, connected, in Hashem, the true Life.
if a person were to be disconnected from his source of life the there is death. which would show that even when he was alive, he was never truly alive. if something is true only sometimes then its not the total truth. same for life. if there will be death, then even when it is seemingly in motion, it is not real life. here is a example.
getting back to our deep hearted, request from Hashem, on shmini Atzeres. "Lechaim Veloi Lamoves". the Bakosho nafshis is that we should be ALIVE. we say LECHAIM, and then we clarify to Hashem what we are asking for with Life that is True real life not because we did not die 'VELOI LAMOVES". we want to be LIVE, LIFE THAT IS TRUE LIFE, not just because we did not die. that is achieved by being connected to the source of life , thru learning Toirah and Doing Mitzvois. here is the connection with the Parsha Vayechi
we know that Yaakov was one of the Three Avois Hakdoishim and his Life was always Dovuk in Hashem. this becomes revealed, only after we see that Yaakoiv LIVED in Mitzrayim, for 17 Years. Lived, means that he was in total connection with Hashem. Yaakoiv's existance in Mitzrayim was not the same that he had experienced ever before in his life.
Beruchnius, he was out of eretz Yisroel. He was in Eretz Mitzrayim, Ervas Hooretz. the most morally corrupt place. But
Begashmius,he had in the best he ever had. he was in a great surrounding with all his family. he was with all his sons and ainiklach, watching grow into a nation. His beloved Son Yoisef was the Moishel in Mitzrayim. Yaakoiv problems were all finished. BUT, with all that, the Toirah Tells us and says Aidus that VAYECHI yaakoiv, he was ALIVE thru his Deveikus and connection with HAshem. this proved and made known that he was always like that . The Avoidah And Dveikus that he had in times of Tzoros was because he was truly Alive and connected. not because he had problems and Tzorois and needed help from Hashem. Yaakoiv is midas EMMES, Yaakoiv does not change with the Surrounding and circumstance. Yaakoiv is always e connected with Hashem. there can be no one that could say that his previous learning and Teffilois were prompted because of his tough situation. Because there is the proof of how he lived when his situation totally changed from Tzorois that seemed to go on and on, to a Harchava that was truly amazing. with all that change he stayed ALIVE and Connected with HASHEM HACHAYIM. actuall his best Years were in the land of Mitzrayim, therefore these 17 years gave LIFE to all the previous years and proved beyond any doubt that Yaakoiv Avinu was a Merkovo to Hashem. always and forever.
They stay Connected and ALIVE. they are VELOI LAMOVES, they never die. they are ALIVE because they are full of life. with simcha and freid they serve Hashem in all matzovim.
if the change is Rachmono Litzlan from good to Bad like by the shevatim, we have to know how the Shevotim acted.
it was lav davka as a punishment, Rather it was in a Kur Habarzel to develop the Yidden where they will become the
"AM HANIVCHAR". where they will be able to say NAASEH VENISHMA, when there was no other nation that said that.

A message from Leah Rubashkin
Tonight, Chof Hay Mar Cheshvan, marks exactly one year from that ominous day when the jury in Sioux Falls, SD came back with that unjust verdict. How painful it was to sit through the trial, hearing all the lies and knowing all the truths that were purposely left out.
Thank you Hashem for all Your kindness and the help and support of our fellow brothers and sisters.
Much has happened since that day. The dirt is now coming to the top and the truth of the overzealous and unjust prosecution of Sholom Rubashkin is becoming known. Hundreds have cried out concerning the outrageous treatment Sholom has received - from Attorney Generals to Congressmen, from Chabad Chasidim to Litvish - and for that we thank Hashem. But the reality still lingers and Sholom still sits in that dark place.
We have the power to change that reality - especially today Chof Hey Mar Cheshvan.
Please use this day to add in Torah, Tefilla and Tzedakah in the z'chus of Sholom Mordechai haLevi ben Rivka and may he merit the geulah he so deserves!

It is time for the Department of Justice to correct this injustice and provide fair justice for Sholom Rubashkin. Already, prominent legal voices are speaking out against the unlawful actions of Chief Judge Linda Reade and the prosecutors in the Rubashkin case. They include Mark Harrison, the former chairman of the American Bar Association’s Commission to Revise the Model Code of Judicial Conduct, and Professor Stephen Gillers, one of the most frequently quoted authority on legal ethics, who teaches at New York University Law School. These ethics experts concluded that Judge Reade violated the Code of Judicial Conduct and the prosecutors engaged in misconduct.

a yid from boro park writes,
although we never met before, we sure spent a lot of time together:)
you and i are iseparable. you are with me during most of my teffilos. you occupy my thoughts frequently every day. some times you are with me during my lonely walks, and occasionally when driving my car or going to sleep. you also join me while spending time with my family and friends and you continue to be part of my shabbos table. you and i are not strangers. in essence we klal yisroel are all actually but one person. and then he brings reb meir shapiro vort of atem kruyim adam
a businessman from boro park on his buissnes stationary writes how he is sitting in his office, a average person but he says
for some reason he has a feeling of emptiness.
" since the unfortunate thing happened with you my children ages 3 and 7 are coming home from school davening for you giving tzedokoh for you my wife benching licht 10 minutes before the zman for you and benching from the siddur etc. ( i like the etc most because that means az men is a hoilech , men geit veiter.)
one day after sentencing in shul someone was saying that your sister was crying and you were mechazik her. i sat down in shul amazed how can a person in such a matzav give chizuk to someone else ? i was thinking a whole day if chas vesholom this would happen to me would i be able to give chizuk to someone else? i spoke to my rov about this last night, he told me it must be the sefer tanya that could give such bitachon."
so this yid starts learning tanya.!!
another yid writes that when he gets up in middle of the night to help give his baby a bottle sometimes his yarmulke would be on the bed and now since this story he makes sure to always wear his yarmulke.!

Baruch Hashem i also received some letters of brochos of chizuk from many yeshovos and also some rabbonim and rosei yeashivah. MI KEAMCHO YISROEL. Hashem sees all this achdus and our teffilos and bakoshos will be answered and in a way of " ad meheirah yorutz devoroi" i want to share some of the feeling that i am haveing with all of you an i am writing

SHOLOM RUBASHKIN DESERVES A NEW TRIAL!
New information shows that Judge Linda Reade, who presided over the Rubashkin trial and sentenced him to 27 years in prison, spent more than six months working to plan the raid on the Agriprocessors plant in Postville.
The judge never disclosed her work, or offered to recuse herself from the trial.
The new information sheds light on some of the decisions that Judge Reade made while presiding over the Sholom Rubashkin case, including imposing a sentence of two years more than what prosecutors recommended.
She apparently had a personal stake in the outcome of the Rubashkin case because she had been involved in the planning of the Agriprocessors raid for more than six months.
Show your support for Sholom Rubashkin by telling the Justice Department to investigate the prosecution and trial of Sholom Rubashkin.

judicial impartiality is often portrayed by Themis, the Greek goddess
of justice, who is blindfolded, with a sword and scales. The blindfold
tells us that the judge will not be swayed by instructions from the
executive branch of government; the scales are meant to show
even-handedness; the sword, indicates that honest decisions will be
carried out.
Allegedly, Chief District Judge Linda Reade was not symbolically
attired in that fashion when she made her ruling in the case against
Shalom Rubashkin. The judge had sentenced the kosher meatpacking
executive to 27 years in prison earlier this summer after he was
convicted on federal financial fraud charges.
According to an article on the website The Cutting Edge, federal
documents and court filings indicate that the judge had been intimately
involved in planning the raid on the Agriprocessors kosher meat plant
in Postville, Iowa, in 2008. The raid led to the trial and sentencing
of Rubashkin.
She “participated in many aspects of the raid and prosecution ‘game
plan’ nearly from its planning inception in October, 2007, some six
months before the raid and long before the ultimate trial of Rubashkin
before her,” the reporter writes.
The judge allegedly did not disclose her involvement in the case as
federal law dictates, although she did state that she had been in
contact with law-enforcement personnel to ensure that the workers in
the plant would have access to attorneys and translators following the
raid.
Rubashkin’s lawyers —Nathan and Alyza Lewin of the District — have
filed papers calling for a retrial and the judge’s recusal.
If these allegations are proven to be accurate, the judge’s conduct was
appalling. A judge being intimately involved in the prosecution of an
accused is a gross violation of the most basic principles of the law.
In trials, appearances count. Even a hint of bias undermines the
public’s faith not only in the decision at hand but the American system
of justice.
That’s especially so in this case where a fervently Orthodox Jew was
tried in a place where most people probably had never even seen a Jew
prior to the meat plant’s opening. And, to further complicate matters,
the defendant was sentenced to 27 years in prison, two years more than
the 25 the prosecution asked for.
We are not advocating for Rubashkin, but rather for impartial judges
and justice, without even a hint of bias.
Toward that end, a new trial would seem to be in order.
